If your wife wants to transfer to a cap-subject employer, she will only be able to do so if the H-1 quota for the fiscal year has not been used up. If the H-1 cap has not been reached then transferring from a cap-exempt employer is no more difficult than transferring from a cap-subject employer. (though the new start date would have to be Oct. 1 or later)

1) As per the law, you and your husband both are supposed to leave the country the next day. But USCIS generally allows upto 30 days to leave. As per the law, he can not stay for a couple of weeks to look for another job. Both of you are supposed to leave the country.
2) Yes. You both will be out of status but you will not be accuring unlawful presence if your I-94 is valid. You will start accuring unlawful presence once the employer withdraws H1B petition. The unlawful presence is the one which will make your bar from the country for 3 years (after 180 days and under 1 year) or 10 years (more than a year).
3) No. It may not be a issue with GC processing. Under 245 rules, unlawful presence upto 180 days is allowed.
4) You have to submit your I-539 petition along with your husband's H1B petition. Your status is tied to your husband's status.

That e-verify thing sounds reasonable, but it is dangerous. The way things work, and as we are seeing now, things like that get expanded and they grow ever more intrusive. Apparently, FP and approvals go in parallel. Checked my case status online, and all 3 of our cases got approved today. The status was set to Decision. I guess it won't go to card production until my wife's FP is done, or maybe my daughter and I will get the card before my wife. Waiting for the snail mail to confirm, seems like an anticlimax after waiting for so many years.

And how does consular processing help? Can I enter US before getting a GC in this case?
Consular Processing allows the beneficiary to remain abroad till the GC is approved at a consulate. At all times the petitioner should show intent to hire you for the future job. If you need to enter US earlier, it's your job to arrange an alternate visa.

I'm on H1 and My spouse is on H4 (came on H4 in Dec 2003)
We are both Canadian PR's. I worked out a deal with my US based to company so that I work in Canada and come to USA occasionally.
Here are a few questions regd my spouse
Planning to apply for H1 in April 2007, Once H1 is approved
-Can we use automatic revalidation to enter USA without getting our visa's stamped. My h1 expired in 2006 and my spouse;s H4 expired in 2006.
(remember my spouse is applying for H1 )
-How safe it is FrequENTLY travel to Canada and back
-How safe it is to stay in Canada for duration of 3-6 months and come back to USA
-Once my spouse gets the H1 approved, should he move to H1 immediatly or can continue on H4?
-stamping of H1 (first stamping for H1 in Canada) after conversion from H4

If USCIS are not giving RN in 90 days. How they will give EAD in 90 days or they will give EAD with RN :) All these are to confuse the congress where we are complaining. :mad:

Many people might have lost job because of last year rally. Here I heard one of company in Chicago area fired all the illegal immigrants in last year immeditely after rally. So this kind of things may not be necessarily positive.
If Illiegals can protest and can have large rallies across the nation then whats the problem with the legals? Why can't we put our point forward through these kind of peaceful but strong measures.:confused:

Yes, a friend of mine was not given her VISA they did not say denial instead said they needed to further confirm her qualifiactions and field of research. This is bc she works in boitech and at that point there was the anthrax scare.

You should be good as long as the existing Visa is valid when you reenter. Even though the existing Visa stamping is tied to your previous employer, You do NOT have to go for Stamping just because you changed the employer and got the new H1. The IO at Port Of Entry might ask about your current employer and you should mention your new Employer and show the new H1B approval at at that time.

Yes you can transfer based on the receipt number. There is not restriction on how many H1B petition can be filed on your behalf by different employers simultaneously. As long as you have no GAP in your paystubs during this transition you should be OK. I have gone through this experience in the past without any issue.

I work with a consulting company on client side. The client is planning a shutdown for 2 days a month - 2nd and 4th friday.
Do you guys think its gonna imapct 485 application. I am asking this question cause the labor was approved for 40/hrs per week and the salary slip shows the number of hrs worked per month which will be lesser than 160 (incase the month has 4 weeks).
BTW, I am on EAD and 140 approved couple of years back.

This move in visa number is dramatic and not to mention scary. It also has the hint that dates will retrogress in FY2008, there is no way that everyone will be processed by the end of this year.
If I were you I would keep the earliest priority date and not worry about the category its in, but then its just me and my choice :). You can judge yourself.

Those of you planning to reach the 485/EAD "heaven". Please have a look at this
link suggesting you apply for EAD 6 months in advance.
